The Purposes and Legal Basis for our Processing of Personal Data

At Finegear, we care about your privacy. For this reason, we collect and use personal data only as it might be needed to help us deliver our services to you.

Our Privacy Policy is intended to describe to you how and what data we collect, and how and why we use your personal data. It also describes options we provide for you to access, update or otherwise take control of your personal data that we process.

This inbox is actively monitored and managed so that we can deliver an experience that you can confidently trust.

Performance of Purchase Agreement

When buying a product from Finegear you enter into a purchase agreement with us.

Finegear processes data such as

  •  your name,
  • address,
  • e-mail,
  • phone number,
  • payment information,
  • customer number and the
  • serial number of your product for the purpose of performing the purchase agreement.

The data is used to for example

  • deliver your product,
  • notify you when it has arrived,
  • control your identity,
  • handle payment and
  • manage returns, support, complaints and warranty issues.

The legal basis for this processing is that it is necessary for our performance of the purchase agreement or to take steps at your request prior to entering the purchase agreement.

You are not obliged to provide the requested personal data, but if the data is not provided Finegear cannot enter into a purchase agreement with you.

We also collect additional information when delivering our services to you to ensure necessary and optimal performance. These methods of collection may not be as obvious to you, so we wanted to highlight and explain what these might be, as they vary from time to time, and how they work. These methods are detailed below:

  • Account related information is collected in association with your use of our services, such as purchases. This usage data can be shared with other Finegear services, such as information requests, customer service requests, and notes or details explaining what you asked for and how we responded.
  • Cookies and similar technologies on our website allow us to track your browsing behavior, links clicked, items purchased, your device type, and to collect various data, including analytics, about how you use and interact with our services. This lets us provide you with more relevant product offerings, a better experience on our website, and to collect, analyze and improve the performance of our services. We may also collect location and system data in the form of your IP address, metadata, log files, and cookie/device IDs when you access our services so that we can personalize our service to you.

This information includes specific data about your interactions with the features, content and links contained within the services, including browser name and version, the date and time the services were used, the type of device used to access the services, what operating system is used, custom unique device identifiers and error data. Some of this data collected might be capable of and be used to approximate your location.

Customer Account

You may register a Customer Account at Finegear to buy products and/or handle issues related to your Finegear product. When registering a Customer Account, we ask you to provide your e-mail address and a password for the purpose of managing your account.

When an order or a support inquiry is placed for the first time, we ask you to provide us with your name, e-mail address, phone number and address for the purpose of handling issues related to your Finegear product, for example to track your order and manage returns, support, complaints and warranty issues.

The legal basis for this processing is that it is necessary to meet your and Finegear’s legitimate interest of handling issues related to your Finegear product and/or that it is necessary for our performance of the purchase agreement or to take steps at your request prior to entering the purchase agreement.

Forum Account

When creating an account on the Forum we ask you to provide us with a username and password as well as your name and e-mail for the purpose of managing your account.

You may also enter additional data to personalize your user profile and when participating in discussions. When registering an account and posting in the forum, Finegear also records your IP-address. The data is used to enable you to participate in the discussion forum.

The legal basis for this processing is that it is necessary in order to meet your and Finegear’s legitimate interest of managing your Forum Account and participate in the discussion forum.

Marketing

If you choose to subscribe to our mailing list, Finegear uses your name and e-mail address for the purpose of direct marketing by sending you newsletters about for example our products, events and offers.

The legal basis for this processing is that you have given consent to the processing of your e-mail address for the purpose of direct marketing and/or that it is necessary in order to meet Finegear’s legitimate interest of direct marketing our products and services.

Contact

If you contact us through our contact form or by e-mailing us we will use the data you send to us, including for example your name and e-mail address, for the purpose of communicating with you and otherwise handle your inquiries and requests.

The legal basis for this processing is that it is necessary to meet your and Finegear’s legitimate interest of contact and otherwise handling your request.

Legal obligations

Finegear may also process your personal data to comply with legal obligations, for example related to product safety, accounting and tax issues. The legal ground for this processing is that it is necessary for compliance with legal obligations to which Finegear is subject.

Website analytics

We use multiple web analytics tools provided by service partners such as Google Analytics or Facebook to collect information about how you interact with our website, including what pages you visit, what site you visited prior to visiting our website, how much time you spend on each page, what operating system and web browser you use, and network and IP information. We use the information provided by these tools to improve our services. These tools place cookies in your browser to identify you as a unique user the next time you visit our website. Each cookie cannot be used by anyone other than the service provider, Google for Google Analytics, for example.

The information collected from the cookie may be transmitted to and stored by these service partners on servers in a country other than the country in which you reside. Though information collected does not include personal data such as name, address, or billing information, the information collected is used and shared by these service providers in accordance with their individual privacy policies.

You can control the technologies we use by managing your settings through the ‘cookie banners” that may be presented, depending on URL of website visited, when you first visit our web pages. You may also control these settings by using third party privacy tools.

Recipients of your Personal Data

We do not sell or trade your personal data with third parties.

Finegear shares personal data with processors, such as firms assisting Finegear in operating our site, logistics and shipping companies, payment service companies and marketing firms, who process your personal data on Finegear’s behalf. When doing so Finegear always makes sure to have relevant data protection agreements in place to safeguard your personal data and make sure that it is only processed for our intended purpose.

When legally obliged to do so, Finegear may also share your personal information with public authorities who are independent controllers and thus process your data for the purposes and means determined by them. When delivering your products Finegear may also share your information with bodies handling the general transport of goods.

Is Your Data Transferred to Third Countries?

If you choose to subscribe to our mailing list, Finegear transfers your e-mail address to Agile CRM, Inc., 22 Heritage Blvd, Princeton NJ 08540, USA, which is part of the U.S. Privacy Shield Framework. The EU Commission has decided that companies who are part of this framework ensures an adequate level of protection.

For How Long Does Finegear Store Your Personal Data?

Information which has been registered in relation to your Customer Account and Forum Account will be stored for as long as the account is active. If you choose to close your Forum Account, all data relating to your account will be erased. If you choose to close your Customer Account, Finegear will close your account. Finegear will however store the information on your Customer Account in accordance with the principles outlined in the above section.

We will store your name and e-mail address for the purpose of direct marketing until you object to this or withdrawal your consent. If you do so, we will immediately erase the data from the list.

Your Rights

You have several rights concerning the processing of your personal data and you are always welcome to contact us concerning this on privacy@finegear.net.

According to GDPR you for example have a right to, under certain conditions:

  • be informed of how your data is being used by Finegear and its processors;
  • access personal data that Finegear has about you;
  • ask Finegear to correct inaccurate personal data;
  • require Finegear to delete your personal data;
  • request transfer of your data to another controller;
  • object to certain kinds of processing; and
  • ask us to restrict the processing of your personal data.

You Have the Right to Withdraw Your Consent

Where Finegear processes personal data based on your consent, you always also have the right to withdraw the consent. This will however not affect the lawfulness of processing based on you consent that has taken place before the consent was withdrawn.

Direct Marketing

You always have the right to object to our processing of your personal data for the purpose of direct marketing and profiling to the extent that it is related to such direct marketing. Finegear will then make sure to cease the use of your data for direct marketing.

Changes to the Privacy Policy

This Privacy Policy was last updated on July 20, 2018. Finegear may update this Privacy Policy from time to time and will inform you of the updates by e-mail and through this website. Please make sure to keep yourself updated on the latest version.
